How is this legal?
In almost every country, there are special regulations that allow the import of a medicine if the particular medicine is not (yet) approved there.
The Named Patient basis
According to medical ethical regulations physicians are allowed to prescribe unapproved medicines for their patients on the named patient import basis, a legal exception of the general rule that a medicine can only be marketed with market approval.

General requirements
The general requirements for the exception to import a non-approved medicine are:
- Your patient suffers from a life-threatening or debilitating disease;
- The medicine you want to prescribe is not (yet) available in your country but is approved elsewhere;
- This is the best treatment option in your opinion, no alternative is available;
- Personal use for an individual patient;
- You will write a prescription as well as, if needed, a brief explanation of your treatment/decision.
What are the risks to you as a physician?
The Named Patient import basis allows physicians to prescribe unapproved medicines.
It is completely safe and legal for you as a physician to prescribe unlicensed or not yet approved medicines to your patients as long as you are prescribing what you believe is in the best interest of your patients in terms of their ongoing treatment and treatment results, according to high medical and ethical standards.
